TaleLens Terms of Service

1. Description of Service

TaleLens offers an AI-powered storybook creation platform designed for parents, teens, and creators to generate personalized, high-quality picture books in both text and image formats.

2. Account Registration & Security

• Account Creation: You must register and provide accurate and up-to-date information to use full features.
• Age Requirements: You must be at least 13. Users aged 13–18 must use the Service under the consent and supervision of a legal guardian.
• Security: You are responsible for your account activity. Keep your login credentials secure.
• Account Ownership: All accounts remain the property of TaleLens.
• No Duplicate Accounts: If banned, you may not create new accounts.

3. Content & Intellectual Property

• Our Property: All software, templates, models, and designs belong to TaleLens.
• Your Inputs: You retain ownership of all original prompts, ideas, and creative input.
• Generated Content Ownership: You own the output you generate, provided it does not violate any laws or third-party rights.
• AI Training License: You grant TaleLens a license to use your content (anonymized) to train models unless you opt out via settings or by emailing support@talelens.com.
• User Feedback: We may freely use your feedback and suggestions to improve our products.
• Content Responsibility: You are solely responsible for the legality and appropriateness of all input and generated content.

4. Special Notice on AI-Generated Content

• Accuracy & Originality: AI-generated content may contain errors or resemble other works.
• Content Review: You must verify and edit content before any use, especially commercial use.
• Third-Party Dependencies: Some AI functionality may rely on external services.
• Disclaimer: TaleLens disclaims liability for the accuracy or legality of generated content.

5. User Conduct & Prohibited Activities

Do not use the Service to:

• Violate laws or regulations;
• Harm or harass others;
• Post obscene, hateful, or discriminatory material;
• Infringe third-party rights;
• Reverse-engineer or disrupt the platform;
• Resell or misuse templates or generated content;
• Use crawlers, bots, or automated access;
• Upload malware or viruses;
• Impersonate others.

6. Subscriptions & Payments

• Some features require a paid subscription;
• We use third-party processors (e.g., Stripe) for payments;
• Subscriptions auto-renew unless canceled at least 30 days prior;
• Payments are non-refundable unless required by law.

7. Indemnification

You agree to indemnify TaleLens from any claims arising from your content, your use or misuse of the Services, or violation of any law or rights of others.

8. Disclaimers & Limitation of Liability

• Services are provided "as-is" without warranties;
• TaleLens shall not be liable for indirect damages, data loss, or profit loss;
• Our total liability is limited to the greater of $100 or the amount paid in the last 12 months.

9. Dispute Resolution & Arbitration

• These Terms are governed by California law and the FAA;
• Disputes require 45-day written negotiation before arbitration;
• Binding arbitration will be conducted by AAA under its Consumer Arbitration Rules;
• No class actions — only individual claims;
• You may opt out of arbitration by emailing us within 30 days of first acceptance.

10. Termination

We may suspend or terminate your access at any time. You may close your account, and content may be deleted.

11. Children's Privacy

We comply with COPPA. Children under 13 must have accounts created and supervised by guardians. We do not knowingly collect children's data without consent.

12. General Terms

• These Terms and our Privacy Policy form the complete agreement;
• We may update Terms and will notify you by changing the effective date;
• Invalid provisions do not affect others;
• You may not assign this agreement; we may assign freely;
• We are not liable for force majeure events.
